President Margvelashvili: The Constitution Should Be a Means of Protection from Mistakes

As a part of the Tbilisi Strategic Discussions, held under the order of the National Security Council of Georgia at the Presidential Palace, the President of Georgia, H.E. Giorgi Margvelashvili, has attended a round table discussion.
At the forum, also attended by foreign experts, the President has delivered a speech and discussed challenges of Georgia and the constitutional amendment process.
According to President Margvelashvili, considering the current challenges facing Georgia, the concept of defense, with sharply defined mandates of action, should be developed and included in the Constitution.
As he further noted, the country should have a structure, which will respond to these challenges and its legitimacy or political expertise should not be put under question. All civic control mechanisms should be involved in this process.
The President has pointed out that while discussing functions of a commander-in-chief and a parliament, the National Security Council and the Armed Forces in relation to the Constitution, the parties should focus not on the separate institutions and their roles, but the current challenges, facing the country’s defense capabilities.
"The defense system should be adequate to the challenges of the country and therefore should not be based on general principles, but the specificities of Georgia. Constitutions of different countries differ in the specificities, traditions and negative experiences of these countries.
This issue should most importantly be taken into account in relation to the country’s defense. Some theorists believe that a constitution is partly a means of protection from past mistakes.
The Constitution is a document of action in crisis, not only the country’s Supreme Law. Therefore, the Constitution should be written by considering our mistakes. We have overcome a military confrontation within the country, in which Georgian Armed Forces took part. We should remember this period; this is an experience, which should be considered while amending the Constitution. Our Constitution should be written considering the wars of the 90’s.
The Constitution, the document ensuring our defense, should be amended by taking into account the challenges of the hybrid wars of the 90’s”, - stated the President.
As he further noted, unfortunately, the Parliament plans to consider the constitutional amendments in the first and second hearings and does not take into account the decision of the Venice Commission.
The President has expressed hope that the major problematic issues of the draft, not only in terms of legal inconsistency and obscurity, but also in the architecture of security, will be adequately solved.
